Terms and Conditions
Mellow Safaris Limited
These terms and conditions outline the agreement between the client and Mellow Safaris Limited regarding safari bookings, payments, cancellations, and travel responsibilities. By confirming a booking and making any payment toward a safari arranged by Mellow Safaris Limited, the client acknowledges that they have read, understood, and agreed to the following terms.
1. Booking Confirmation & Contract
A binding contract between the client and Mellow Safaris Limited comes into effect once a booking is confirmed and the required deposit has been received. The person making the booking accepts these terms on behalf of all persons included in the reservation. All clients must ensure that names provided match exactly with passport details.
2. Deposit & Payment Terms
To secure your booking, a 50% deposit is required at the time of booking. The remaining balance is due 1–45 days before safari departure. Payments can be made via bank transfer or secure online payment link. Failure to complete payment by the due date may result in cancellation of the booking.
3. Payment Methods
- Bank transfer
- Credit/Debit card payments
- Online payment gateways (where available)
A 3.5% processing fee applies to card payments. Clients are responsible for bank transfer charges.
4. Cancellation Policy
All cancellations must be submitted in writing via email.
Cancellation Charges (Per Person):
- 61+ days before departure: 30% fee
- 46–60 days: 50% fee
- 31–45 days: 75% fee
- 0–30 days: 100% fee
5. Supplier Cancellation Policies
We work with lodges, airlines, and transport providers across East Africa. Their cancellation policies may apply and, where stricter, will override our standard policy. Non-recoverable costs will be deducted from refunds.
6. Refund Policy
Refunds are processed after confirmation from suppliers. Deductions may include:
- Non-recoverable costs
- Payment processing fees
- Bank charges
- Services already confirmed or booked
Refund timelines depend on supplier processing.
7. Changes to Bookings / Rebooking
Changes are subject to availability and may incur additional costs. A 5% amendment fee applies to confirmed bookings. Late changes may be treated as cancellations depending on supplier policies.
8. Travel Insurance
Clients are strongly advised to obtain comprehensive travel insurance covering:
- Trip cancellation
- Medical emergencies
- Injury or illness
- Lost luggage
- Evacuation
- Flight delays
Mellow Safaris Limited is not responsible for losses due to lack of insurance.
9. Liability
Mellow Safaris Limited acts as an intermediary between clients and third-party service providers. We are not liable for:
- Injury or illness
- Loss or damage of property
- Delays or cancellations
- Weather or road conditions
- Third-party service failures
Participation is at the client's own risk.
10. Force Majeure
We are not responsible for disruptions caused by:
- Natural disasters
- Government restrictions
- Political unrest
- Pandemics
- Airline disruptions
- Park closures
We will, where possible, offer alternatives or rescheduling.
11. Client Responsibilities
Clients must ensure:
- Valid passports
- Required visas
- Vaccinations (if required)
- Travel insurance
Failure to meet entry requirements is not grounds for refund.
12. Jurisdiction & Governing Law
These terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to Kenyan courts.
13. Payment Disputes & Chargebacks
Clients agree not to initiate chargebacks without first contacting Mellow Safaris Limited. Unjustified chargebacks may result in recovery of funds and legal costs.
14. Use of Images, Videos & Testimonials
Mellow Safaris Limited may use photos and videos from safaris for marketing purposes. Clients who do not wish to appear must notify us in writing before travel.
15. Acceptance of Terms
By confirming a booking and making payment, the client agrees to these terms and conditions.
